Tibby Terms of Use
Last updated September 30, 2026
1. Who we are
Tibby is a book tracker made by Appthalmology Inc., Ottawa, Ontario, Canada. These terms cover your use of Tibby and its book services. By using them, you agree to these terms. For help or questions, email hello@tibbyreads.com.
2. Age and permission
You must be 13 or older to use Tibby. If local law requires a parent or guardian’s permission to agree to these terms, you need that permission. If you are below your country’s age for consenting to online data processing, you also need their consent before using features that send your information, including photo and voice recognition. These can be different age rules.
3. Using the app
We give you a personal, non-exclusive licence to use Tibby, subject to these terms and payment for paid features. On iPhone and iPad, Apple’s standard licence governs the app licence; these terms supplement it. For the Android release, Google Play’s terms also apply to downloads and purchases. The applicable store’s licence and payment rules take priority on those matters, subject always to mandatory consumer law.
4. Tibby Pro
Pro unlocks adding more books, library imports, arranging and decorating shelves, more bookcases, and reading goals and streaks. Available features depend on your app version and platform; the purchase screen describes what your plan includes. Recognition and book lookups have the limits described below.
Plans are weekly or yearly, with no free trial. The store shows the price, currency and billing period before you confirm. Apple or Google bills your store account when you subscribe and automatically renews the plan each week or year until you cancel. Price changes follow the store’s notice and consent rules and applicable law.
- Apple: cancel in your device’s Settings → your name → Subscriptions → Tibby Pro. Cancel at least 24 hours before renewal to avoid the next charge.
- Google Play: cancel in Play Store → profile → Payments & subscriptions → Subscriptions → Tibby, before the next renewal.
You normally keep Pro until the paid period ends, unless a refund or applicable law ends it sooner. After Pro ends, paid features lock; your saved library is not deleted. Removing Tibby or deleting its data does not cancel a subscription.
Request refunds through Apple or Google Play, depending on where you paid. Their process does not remove any refund or other remedy you are entitled to by law. Contact us if you need help.
5. Your library and photos
You keep your rights in your library, notes and your own photos. They are saved on your device; this version has no Tibby account copy or library sync. Device backups, files you export and images you share may leave your device at your direction or under your backup settings. Keep a backup of anything you want to preserve.
Book details leave the device for catalogue matching. If you choose photo or voice recognition and consent, the photo or recording goes to our server and our AI provider, which read the book titles, and a book catalogue then finds the editions. We use it only for that request; our server keeps what was read from it for up to an hour, so a retry doesn’t send it again. Providers may retain and review it for safety as explained in the privacy policy. Agreeing to these terms does not replace the feature’s separate consent.
Only submit material you have the right to use. You allow us and our providers to process what you send as needed for your request and the handling described in the privacy policy. You do not give us permission to publish your content or use it in advertising.
6. Book services and fair use
Use the book server and AI features through Tibby’s intended features. Do not scrape or resell catalogue results, automate requests outside those features, disrupt the service, or bypass purchase checks or usage limits, including by reverse engineering. Built-in imports and accessibility tools are allowed. This does not restrict rights the law or an open-source licence gives you.
Daily and monthly allowances, short-term rate limits and temporary pauses may apply, including with Pro, to manage shared capacity, costs and abuse. Pro does not include unlimited AI requests. Book information and covers come from third parties and may be incomplete or wrong. Recognition can make mistakes; check matches before saving. Tibby’s Picks are suggestions, not a promise that a book will suit you.
7. Tibby’s name and artwork
Tibby’s name, mascot and original artwork are ours. We retain our rights in them and the app. You may share shelf images using Tibby’s sharing features. This does not transfer our branding or artwork to you. Book covers, third-party material and your own content remain subject to their owners’ rights.
8. Changes and ending use
We may update features and these terms to improve Tibby, fix problems, protect the service or meet legal requirements. We will date revised terms and explain material changes in the app before they take effect, with any additional notice, consent or cancellation rights required by law. Changes will not remove rights for a paid period already purchased. We will update the privacy policy before adding accounts or sync.
You may stop using Tibby at any time. Save any backup first, then use Settings → Your data → Delete all my data to erase your local library and photos. Remove any backups separately and cancel your subscription in the store. Some purchase, security and service records remain as described in the privacy policy; email us about deletion requests.
We may restrict book-server access for serious misuse or security reasons. Where possible, we will explain why and how to contact us through an in-app notice. Urgent protection may require an immediate restriction. Any rights to a refund or other remedy remain.
9. Service limits and your rights
We work to keep Tibby useful and reliable, but cannot promise uninterrupted service or error-free results. Your statutory rights to service quality and remedies still apply.
The following liability exclusion does not apply to consumers in Quebec. Where the law permits, we are not liable for indirect losses or lost business profits. This does not exclude liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by our negligence, or anything the law does not allow us to exclude.
Nothing in these terms takes away mandatory consumer rights, including in Quebec and the European Union: legal guarantees, refunds, withdrawal or cancellation rights, and access to courts remain available where the law provides them.
10. Governing law
The Ontario choice of law below does not apply to consumers in Quebec; Quebec law and applicable Canadian federal law apply to them. Otherwise, these terms are governed by Ontario law and applicable Canadian federal law. You keep the mandatory protections of the place where you live, including any right to bring a claim in your local courts.
